You did your first few jobs for cash. Then a customer asked for your “business info” so they could pay you, and you weren’t sure what to say.

So now you’re wondering: do I need an LLC, or am I fine as just me?

Here’s the short version, in normal words. This isn’t legal or tax advice, and rules change by state, so check your state’s business office or talk to an accountant before you file anything.

## The real difference between an LLC and a sole proprietor

**A sole proprietor is you, doing business.** You don’t file anything to become one. According to the [SBA](https://www.sba.gov/business-guide/launch-your-business/choose-business-structure), you’re automatically a sole proprietor if you do business and don’t register as anything else. The catch: your business debts and lawsuits are your personal debts and lawsuits.

**An LLC is a separate legal entity you register with your state.** The SBA says an LLC protects your personal assets, like your house, truck, and savings, in most cases if the business gets sued or goes under. You pay a state filing fee and usually some kind of annual report fee.

Taxes are closer than people think. By default, the [IRS](https://www.irs.gov/businesses/small-businesses-self-employed/single-member-limited-liability-companies) treats a single-member LLC as a “disregarded entity,” which means profit flows onto your personal return, just like a sole proprietor. Either way, you still owe self-employment tax on what you make.

## When an LLC is worth it

The SBA describes sole proprietorships as a fit for low-risk businesses and for testing an idea, and LLCs as a fit for medium- or higher-risk businesses and owners with assets to protect.

For trades, that usually points one way. You’re on ladders, on roofs, inside people’s homes, around water lines and wiring. An LLC is worth a serious look if:

- **You work on other people’s property.** Damage claims happen.
- **You own a house or have savings** you’d hate to put at risk.
- **You’re hiring help,** even part-time.
- **Bigger customers or general contractors ask for it.** Some want to see an entity name, an EIN, and insurance before they’ll hire you.

Staying a sole proprietor can make sense for a while if you’re testing the waters, doing small low-risk jobs, and have good insurance.

## An LLC is not a force field

Two things people miss:

1. **Insurance still matters.** The SBA notes that LLC protection has limits. General liability insurance is what actually pays when something goes wrong on a job.
2. **Mixing money weakens it.** If business and personal money live in the same account, it’s harder to show the LLC is really separate. Open a [business bank account](https://gbpn.com/blog/business-bank-account-for-llc/) and keep it clean.

**For a deeper dive:** Northwest Registered Agent has a detailed [sole proprietorship vs LLC comparison](https://www.northwestregisteredagent.com/llc/sole-proprietor-vs-llc), including state fees and annual reports, and LLC University covers [LLC vs sole proprietorship vs corporation](https://www.llcuniversity.com/llc-vs-sole-proprietorship-vs-corporation/) if you’re also weighing a corporation.

## How to set up either one

**If you stay a sole proprietor:**

1. Register a DBA if you use a business name that isn’t your own name (check your county or state).
2. Get any trade license your state or city requires.
3. Get an [EIN](https://gbpn.com/blog/how-to-get-an-ein/) if you want one. It’s free from the IRS, and it keeps your Social Security number off customer paperwork.
4. Open a separate bank account.

**If you form an LLC:**

1. Pick a name and check it’s available with your Secretary of State.
2. Name a registered agent (you can be your own in most states, or pay a service).
3. File articles of organization and pay the state fee.
4. Write a simple operating agreement. The SBA recommends one even when your state doesn’t require it.
5. Get your [EIN](https://gbpn.com/blog/how-to-get-an-ein/) after the LLC is formed. The IRS says to form with the state first.
6. Open a business bank account and get insurance.

## Whichever you pick, separate the business from you

The point of either structure is the same: a real business that’s clearly not your personal life. That shows up in small places customers notice:

- A business name on invoices, not just yours.
- A business bank account they pay into.
- A [business phone number](https://gbpn.com/blog/separate-business-phone-number/) instead of your personal cell on the truck and on Google.

The phone part is the one most people put off, because it feels like it means a second phone. It doesn’t.

## A business number, set up for you

With **GBPN**, you get a business number that rings the cell you already carry, for **$30 a month total, taxes and fees included.**

- **Business calls announce themselves,** so you know to answer with your business name.
- **We record your business greeting for you.**
- **Business hours,** so after-hours calls go to voicemail while your phone stays on for family.
- **Room for your team** on the same number when you start hiring.

A real person sets it up with you. **30-day money-back guarantee.**

## FAQ

**Is an LLC better than a sole proprietorship?** Not always. An LLC usually adds liability protection for a state fee and some paperwork. For riskier work or if you have assets to protect, many owners find it worth it.

**Do I pay more taxes with an LLC?** Not by default. A single-member LLC is taxed like a sole proprietor unless you choose a different tax treatment. Ask an accountant about your situation.

**Can I switch from sole proprietor to LLC later?** Yes. Lots of people start as sole proprietors and form an LLC once work picks up. Whether you need a new EIN depends on the details. The IRS says a single-member LLC can often keep using the owner’s sole proprietor EIN if it has no employees and isn’t taxed as a corporation. See the IRS page on [when to get a new EIN](https://www.irs.gov/businesses/small-businesses-self-employed/when-to-get-a-new-ein).

**Do I need a lawyer to form an LLC?** No. Most states let you file online yourself. A lawyer or accountant is worth it if you have partners or a complicated setup.

**Does an LLC protect me if I make a mistake on a job?** Not completely. Your own work can still come back on you. That’s what liability insurance is for.
